Who Qualifies for an EB-3 Visa?

Skilled Workers (EB-3A): Individuals with at least two years of training or experience in their field (e.g., designers, supervisors, technicians).
Professionals (EB-3B): Applicants holding a bachelor’s degree or its equivalent, such as engineers, architects, or teachers.
Unskilled Workers (EB-3C): Workers with less than two years of experience, performing non-seasonal, full-time work (e.g., caretakers, nannies, janitors).

EB-3 Visa Requirements

Applicants must have a full-time job offer from a U.S. employer willing to sponsor them. The employer must complete the PERM labor certification to prove that no qualified U.S. worker is available for the job. Once certified, the employer files Form I-140 (Immigrant Petition for Alien Worker) and must offer the prevailing wage and demonstrate the ability to pay.

Application Process

The EB-3 process starts with labor certification from the Department of Labor, followed by the employer’s I-140 petition. After approval, the applicant receives a priority date and may apply for adjustment of status (Form I-485) if already in the U.S., or proceed with consular processing if abroad. Once approved, the applicant becomes a lawful permanent resident (green card holder).
